AGREEMENT – HELLY HANSEN
PARTIES
The website www.hellyhansen.com.au (the “Website”) is a site operated by Helly Hansen Australia PTY LTD, Unit 4-5/16-22 Cross Street, Brookvale NSW 2100 Australia, 2100, Australian Business Number 33 169 813 638 and is hereinafter referred to as the “Seller”. The Buyer is the person stated as Buyer in the Order (the “Buyer”). The Seller supplies the Products (“Products”) listed on the Website.
These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”).
PRICES
Information about the total amount to be paid by the Buyer, including federal, state/provincial, and local taxes, including environmental fees and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the Order before payment is made.
ENTERING INTO THE AGREEMENT
The Seller will acknowledge receipt of the Order electronically. All Orders are subject to acceptance by the Seller. As the acknowledgement of receipt is not acceptance of the Order, the Seller will confirm such acceptance to the Buyer by sending an e-mail that confirms that the Product has been despatched (the “Order Confirmation”). The Buyer shall review the Order Confirmation for any non-compliance with the Order both in terms of numbers, type of Product, price etc. Any discrepancy between the Order and the Order Confirmation shall be reported to the Seller as soon as reasonably possible either by clicking the contact us button here, or by calling the Seller at (02) 8068 8600. Seller cannot be held liable for and is not bound by writing or typing errors occurring in the communication with the Buyer.
Seller reserves the right to cancel an Order or a part of an Order if the Product is out of stock. The Seller also reserves the right to cancel Orders which are assumed to be subject to resale. Seller will promptly notify the Buyer of the cancellation and will offer a full refund for all monies paid for the cancelled Order.
DELIVERY ETC.
The Seller aims to ship the Order within two business days of the date of the Order confirmation. If Seller anticipates a delay in shipping the Order beyond two days, Seller will notify Buyer of the delay and provide a revised shipment date, as well as an opportunity for the Buyer to cancel the Order.
Delivery will be made to the address stated in the Order. The Buyer chooses the method of delivery from the choices offered upon of Ordering. Delivery costs such as shipping and handling charges are in addition to the price of the Products and will vary depending on your shipping address and the method of delivery selected.
The Seller is not responsible for delay in delivery due to invalid shipping address submitted by the Buyer. The Buyer is responsible for reviewing shipping address at checkout and notifying Seller of any invalid shipping address entries.
The date of delivery will depend on the Buyer’s chosen method of delivery.
THE RISK FOR THE PRODUCT
The Buyer is responsible for loss or damage to the Product from the time the item is delivered to the Buyer according to the Agreement. If the time of delivery has arrived and the Buyer fails to have the Product delivered to them after the Product is available to the Buyer, the Buyer will be responsible for any loss or damage to the Product.
RIGHT OF CANCELLATION
The Buyer may cancel the purchase of the Product without penalty and will receive a full refund or credit within three days, with no additional charges or fees. Cancellation of the purchase is not guaranteed as the Seller uses automatic systems that cannot be stopped once and order is placed. Buyer needs to call customer service at +61 (2) 8068 8600 or email; customercare@hellyhansen.com.au and ask to cancel order.
After shipment, the Buyer may return their purchase with 60 days of receipt for any reason providing the the item is in the original condition. Buyer needs to call customer service at +61 (2) 8068 8600 or email; customercare@hellyhansen.com.au for return authorisation number.

If you are not satisfied for any reason, with your product(s) purchased online (via this site) that are unused and in a saleable condition, you can return it to us for a full refund for the price you paid for returned item(s).
HOW TO RETURN A PRODUCT:
- To return a product, please call us at (02) 8068 8600 or email customercare@hellyhansen.com.au between 9:00am and 5:00pm Australian Eastern Standard Time, Monday to Friday.
- We will provide you with a return authorisation number.
- You can then send the product back to us at:

For all returns due to change of mind, shipping costs are to be paid by the Buyer and will not be refunded. The Buyer is to track his parcel, the Seller takes no responsibility for returns lost in the delivery process.
ITEMS MAY BE RETURNED IF:
- The products are unwashed and unused (you can of course try the item on for fit)
- The product is in its original undamaged packing (a carefully opened package is fine)
- All tags are attached
- The product is complete (e.g. both items of a pair must be returned)
If the Buyer returns his order without contacting customer service and acquiring a return authorisation number, the Seller may not be able to process the return and cannot guarantee a refund.
NOTE: The above return terms are for our online store only. For more information regarding in-store returns please visit your local Helly Hansen store.
EXCHANGES
The Seller only replace items if they are defective or damaged. The Seller cannot facilitate exchanges, however accepts returns and provides a full refund if the garment is not the right fit. The Seller recommends the Buyer returns his garment(s) and place a new order for the correct size(s) as soon as possible due to high sales volumes and return processing times.
PRODUCT NOT IN ACCORDANCE WITH ORDER, DEFECTIVE OR DAMAGED ON DELIVERY
When the Buyer receives the Product, he or she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects.
WARRANTY
All Helly Hansen garments and footwear are warranted to the original owner against defects in materials and workmanship. Should any garments purchased fail due to a manufacturing defect within two years (footwear one year) of the purchase date, we will repair it without charge or provide a replacement, at our discretion. This warranty does not cover damage caused by accident, negligence or normal wear and tear. Always follow care instructions supplied inside the product and for further general care instructions.
If the Buyer believes the product received is defective or the product has started showing a defect within the warranty period, the Buyer will need to return the item together with proof of purchase. Any notices of default must be made by calling customer service at +61 (2) 8068 8600 or emailing customercare@hellyhansen.com.au before the Buyer returns the product.
BUYER’S DEFAULT
If the Buyer does not submit payment according to the Agreement, or payment is rejected or denied (in the case of payment by credit, debit or bank card), the Seller can cancel the Agreement.
PERSONAL INFORMATION – PRIVACY
The Seller will collect and store personal information that is necessary in order for the Seller to be able to comply with the obligations under the Agreement.
This website is a general audience website and is not targeted to or intended for use by children. This site will never knowingly request or collect personally identifiable information from children under the age of 13.
If the Buyer has provided his or her consent, the Seller may use the Buyer’s personal information for other purposes, for example sending advertising material or information about Products. Such voluntary and informed consent may be given by the Buyer upon entering into the Agreement.
The Buyer can contact the Seller, either by phone at (02) 8068 8600 or by clicking the 'contact us' button here if the Buyer has questions about the Seller’s use of personal information, or if the Buyer wants to cease the use of or change the personal information.

HOW TO RETURN A PRODUCT:
1. To initiate the return and refund of your goods, please send your order to the address provided below.
Make sure to include your original order number on the return shipping label after 'c/o #'. Failure to include your order number may compromise the processing of your refund. If you are returning goods from multiple orders, include both order numbers with a '/' separating them. For example, 'c/o #806800001/806800002'.

Local residents, please feel free to return your order in person between 9:00 am and 5:00 pm AEST, Monday to Friday.
Customers are responsible for covering the return costs associated with a change of mind or incorrect sizing. Please note that the original postage fee will not be refunded upon completion of the return process.
2. Please retain your proof of postage. Helly Hansen takes no responsibility for returns lost in the delivery process. For returns due to a change of mind or size, shipping costs will not be refunded
3. Returned items will be processed within 72 hours of receiving them. You will receive an email notifying you that a refund request has been issued to your banking institution.
